FAA Responds To Grant-Valkaria's Anti-Aviation Efforts
FAA: Town has NO legal standing to regulate X59, period.

The FAA is clearly beyond sick and tired of the B.S. flowing in copious quantities from the anti-airport forces in control of Grant-Valkaria's Town Council, as this 14-page letter to the town attorney shows.

This letter refutes every argument the town presented trying to justify their attempts to illegally regulate aeronautical activities at Valkaria Airport (which of course the town doesn't even own), and even refutes statements made by Mayor Del Yonts to the newspaper.

None of the many relevant and long-established legal precedents explained in this letter and which have been given to them from various other sources are "hidden" from public access for anyone with Internet or library access. They should be REALLY should be easy to find by anyone in the legal profession, despite the claims of Town Attorney Karl Bohne that his public statements that his so-called "research" showed that this ordinance was valid and enforceable. But, as the council members clearly and gleefully stated during the meeting, they feel it is their personal responsibility to establish a new national precedent to prove that the Federal Aviation Administration really has no authority over aeronautical activities at airports when federal law conflicts with the desire of the town, even when said town doesn't even own the airport in question.

The FAA isn't even required to waste their time (and our tax money) in explaining such basic facts to a non-sponsor entity like this, especially since the Town Council obviously chooses to continuously ignore all the other obvious warnings they've been given over the past few years by the FAA, FDOT, Brevard County, concerned citizens, AOPA, EAA, etc. Unfortunately, inconveniences like facts, logic, legal precedent, the US Constitution, and serving the best interests of the town's citizens have very little to do with the ongoing actions of this Town Council!! Sadly, the town citizens will inevitably be left holding the bag for their council's indescribable arrogance and utter foolishness to carry out a childish personal vendetta.

While I believe the entrepreneurs and businessmen and women know how to kick the door wide open and establish needed space economic infrastructure to develop this new industry, I have my doubts about policy makers, our elected officials, and those motivated to hold on to old agendas that won't work for the new space economy.
